Marijuana Laws in Texas

In May 2019, the Texas Senate advanced a bill that extended the list of debilitating illnesses that can legally be treated with cannabis oil and other low-THC marijuana products in the state. In June 2019, Governor Abbott signed HB 3703 into action, and the Texas Legislature Online says that it is to go into effect immediately. While our neighboring states have passed more sweeping decriminalization laws and in some cases even legalized recreational use, though, marijuana use outside the scope of HB 3703 remains illegal in Texas, with stiff penalties.

Here’s What You Need to Know About Texas Marijuana Laws

This bill expands the list of conditions that qualify for low-dose medical marijuana to include all forms of epilepsy, seizure disorders, multiple sclerosis, spasticity, amyotrophic lateral sclerosis (ALS), terminal cancer, autism, and incurable neurodegenerative diseases. The bill also removes the prior requirement that new patients have the approval of two licensed neurologists, and instead only requires one. Public school students who qualify will be exempt from disciplinary action for the possession or use of low-THC cannabis. Importantly, the maximum amount of THC that medical marijuana products can contain remains capped at 0.5%.
