Who is Considered a Juvenile?

In the state of Texas, if a person is between the ages of 10 and 17 they can be charged as a juvenile. At the age of 17 a person is recognized as an adult according to the Texas legal system. If your child is within this age range and has been charged with a crime, you should hire a juvenile lawyer.

Punishments for Juveniles who are Convicted of Crimes

In most cases the court system will assign a punishment that fits the crime, such as:

  • Fines. In cases of property damage the punishment will usually involve paying for any damages that the juvenile inflicted. The fines may be the responsibility of the parent or the child, depending on age.
  • Community Service. One of the most common forms of punishment for juveniles is community service. Often the type of community service assigned is related to the crime that was committed. For example, if vandalism was the crime, the community service assigned may involve cleaning up or repairing city property.
  • Probation. Juveniles may be put on probation for a period of time following a conviction. They may have limited freedom to be away from their home (limits on distance and hours) and will be required to report to their probation office regularly.
  • Juvenile Detention. In the case of certain crimes, repeat offenses, or positive drug tests, a child may be required to stay at a juvenile detention center for a period of time.
  • Parental Consequences. When on probation, a juveniles parents are also placed on conditions of probation and are subject to drug and alcohol testing and reporting requirements.
  • Parental Financial Impact. In some cases, the parents may be required to reimburse the county for the cost of incarceration for a juvenile.

How a Charge or Conviction Affects a Juvenile’s Permanent Record

Juvenile crimes stay on your permanent record until you have them sealed or expunged. When a criminal charge is sealed, it is as if it never happened. You can truthfully answer on a job application that you have not been arrested, convicted, or adjudicated of a crime. It can only be opened with permission of the juvenile justice court in specific situations. Some criminal charges can be expunged, which means they are completely removed from the person’s record, but not all crimes are eligible. But it’s best to avoid a conviction in the first place by hiring the best defense attorney from the start.

What A Juvenile Defense Attorney Can Do

In addition to being an essential guide through the process, a juvenile defense attorney will take a number of steps to help find the best possible legal outcome for your child.

An experienced defense attorney can help present your child in the best possible light to the court. Presenting a child in the right light can make a huge difference in a court’s decision-making process.  Good attorneys can skillfully negotiate for a lesser sentence and provide necessary evidence that can be convincing to a judge and jury.

It’s not unusual for an experienced attorney to get a case dismissed or rejected altogether. They might also find a way for the case to be resolved in an informal manner, outside of the courtroom.  If a case does go to court, an experienced defense attorney will take the proper steps to fully understand the circumstances and your child’s version of events as it pertains to the alleged crime.

Parents can help their child’s odds in court by collecting and organizing all available evidence to pass over to an attorney. Documentation of positive accomplishments, report cards, and letters of recommendation from the community can all make a positive impression on the court.

An attorney can help organize this information and present them in a helpful manner. An experienced attorney is likely familiar with the local courts and will know the best strategy to employ for success.

Your child’s future is not something to gamble with. An experienced attorney is your best bet at avoiding serious criminal charges for your teen.
